Tier A MS4 Tree Removal/Replacement Model Ordinance: What is it?

The NJ Shade Tree Federation, promoted in partnership with the NJ Association of Planning & Zoning Administrators, is offering a three Session Webinar Series. These webinars are pre-approved for 1.5 NJUCF CEUs/session when attended live and with proper documentation, and Rutgers P/Z approved for 1.5 Technical CE credits/session.
This session will provide an overview of the NJDEP’s 2023 Tier A MS4 permit renewal requirement for permittees to, at a minimum, adopt and enforce a community-wide ordinance to control tree removal and replacement for all types of properties where the municipality has jurisdiction. The tree ordinance requirement is meant to be enforced community-wide to control tree removal and replacement to reduce stormwater runoff and pollutants, and to promote infiltration of rainwater into the soil. This session will review the model ordinance template developed by the DEP that may be adapted, in whole or in part, to fit a municipality’s individual needs, making sure that the changes do not prevent the ordinance from meeting the permit minimum standard of addressing both tree removal and replacement on public and private property within the municipality’s jurisdiction.
